Democrat California Congressman Eric Swalwell is facing a massive credibility crisis that could torpedo his bid for governor.
A hard-hitting court filing from conservative powerhouse Joel Gilbert lays it all out: Swalwell doesn’t actually live in the Golden State, which means he’s got no business running for its top job under state law.
Gilbert dropped the complaint in Sacramento. He’s calling out Swalwell as the presumed heir to Governor Gavin Newsom’s throne, but argues the Democrat’s real home is in the swamp of Washington, DC.
The filing pulls no punches, diving deep into public records to prove Swalwell’s disconnection from California. “Public records searches reveal no current ownership or leasehold interest held by Eric Swalwell in California, nor any history of any ownership of leasehold interest based on available public records,” the petition stated.
On top of that, Gilbert highlights Swalwell’s own paperwork as a smoking gun. “Swalwell’s congressional financial disclosers from 2011 to 2024 list no California real estate ownership.”
According to Gilbert, even the address Swalwell slapped on his December 4 campaign filing turns out to be a total farce – it’s just his lawyer’s office, not any kind of home where he hangs his hat.
This all crashes head-on with California’s ironclad rules for who can lead the state. Per the California constitution, “The governor shall be an elector who has been a citizen of the United States and a resident of this state for 5 years immediately preceding the governor’s election,” the filing states.
Gilbert isn’t messing around; he’s demanding Swalwell get booted from the ballot entirely because of these revelations.
In a statement to the Daily Mail, Gilbert put it bluntly: “Either he’s guilty of mortgage fraud in Washington, DC, or he’s ineligible to run for governor of California. He can’t have it both ways.”
Swalwell, a married dad with three kids, grew up in California after being born in Iowa.
Per his Congressional profile, he kicked off in local politics, getting elected to the city council in Dublin, California, back in 2010. That was his foot in the door before jumping to Congress in 2013, where he’s been ever since.
Now, he’s gunning for governor, tossing his name into the race last year like it’s his birthright. But if Gilbert’s claims stick, this whole ambition could crumble like a house of cards.
