Because Donald Trump just launched a new lawsuit against Joe Biden that put all of Washington, D.C. on notice.

Trump to Sue Justice Department for $100 Million Over Mar-a-Lago Raid

Former President Donald Trump is preparing to sue the Justice Department for $100 million, accusing the agency of “political persecution” in connection with the 2022 raid on his Mar-a-Lago estate in Palm Beach, Florida. Trump’s legal team contends that the raid, part of a federal investigation into his handling of classified documents, was carried out with the intent to target him politically.

According to a memo first obtained by Fox News, Trump’s legal representatives argue that the U.S. government engaged in “tortious conduct” against him during the raid conducted by the FBI on August 8, 2022. This legal action comes after Special Counsel Jack Smith, appointed to oversee the investigation, charged Trump with 37 felonies, including willful retention of national defense information and obstruction of justice. Trump pleaded not guilty to all charges.

However, U.S. District Judge Aileen Cannon dismissed the case last month, ruling that Smith’s appointment and the subsequent indictment were unconstitutional due to a violation of the Appointments Clause. This ruling has paved the way for Trump’s lawsuit against the Justice Department, which his attorney Daniel Epstein has already filed a notice for. The Justice Department now has 180 days to respond before the case potentially moves to federal court in the Southern District of Florida.

In a statement to Fox Business, Epstein emphasized that Trump’s legal action is not only a defense of his own rights but also a stand for all Americans who believe in the rule of law. Epstein’s filing accuses the Justice Department and the FBI of violating Trump’s privacy rights, engaging in malicious prosecution, and abusing legal processes.

“What President Trump is doing here is not just standing up for himself – he is standing up for all Americans who believe in the rule of law and believe that you should hold the government accountable when it wrongs you,” Trump attorney Daniel Epstein shared with reporters.

He argues that the decisions made by Attorney General Merrick Garland and FBI Director Christopher Wray were politically motivated and not based on sound legal principles.

Epstein further claims that the raid on Mar-a-Lago violated established protocols for dealing with former U.S. presidents and that Trump’s privacy was unjustly intruded upon. He also argues that the subsequent prosecution lacked constitutional grounds, citing the Supreme Court’s ruling on presidential immunity from prosecution for official acts.

“Garland and Wray should have never approved a raid and subsequent indictment of President Trump because the well-established protocol with former U.S. presidents is to use non-enforcement means to obtain records of the United States,” Epstein added to his comments on the matter. “But notwithstanding the fact that the raid should have never occurred, Garland and Wray should have ensured their agents sought consent from President Trump, notified his lawyers, and sought cooperation.”

The lawsuit seeks $100 million in punitive damages, with Epstein arguing that Trump has suffered $15 million in actual harm due to legal costs incurred from defending against the charges brought by the Special Counsel. Epstein’s notice to the Justice Department includes a certification signed by Trump, officially designating Epstein as his legal representative in the case.

“For these harms to President Trump, the respondents must pay punitive damages of $100 million,” Epstein alleged of the lawsuit.

The Justice Department has declined to comment on the matter. Epstein, however, insists that the case represents “very accurate and precise election interference,” arguing that the entire investigation was designed to disrupt Trump’s chances of re-election.

This legal battle could have significant implications, not only for Trump’s political future but also for the broader debate over the powers and accountability of government agencies.

A number of lawyers uninvolved with President Donald Trump have suggested that the raid on his Mar-a-Lago estate certainly has legally dubious grounds and that it’s not a stretch to argue that it was politically motivated in nature and unconstitutional.

The videos that were released showing the behavior of the FBI and DOJ officials treating Donald Trump’s home with complete disrespect when they were raiding it is certainly not a good look for these federal agencies that are quickly losing trust from the American people.
