House Republicans have issued a subpoena for Anthony Bernal, former chief of staff to Joe Biden and a key confidant to Jill Biden, to probe whether there was a deliberate effort to conceal the 46th president’s cognitive decline during his tenure.
The move signals a continued push to scrutinize the Biden administration’s inner workings, with GOP lawmakers questioning the transparency of a presidency marked by stumbles and missteps.
Bernal, described as a fiercely loyal “bulldog” operative and Jill Biden’s “work husband,” informed the House Oversight Committee on Wednesday that he would not voluntarily participate in a transcribed interview.
Republicans are undeterred, demanding his deposition on July 16 to address allegations of a cover-up. “The American people deserve to know if Biden’s team was propping up a faltering leader while shielding his limitations from public view,” a GOP source remarked.
Stonewalling from Biden’s Loyalist
Bernal’s refusal to cooperate echoes last year’s standoff when the White House blocked a similar subpoena from Oversight Committee Chairman James Comer.
This time, non-compliance could lead to a contempt citation and potential criminal charges enforced by the Justice Department.
The Biden camp’s resistance, critics argue, only fuels suspicions of a concerted effort to obscure the former president’s mental and physical capacity during his term.
Bernal’s proximity to the Biden family sets him apart from other aides like Neera Tanden, former Domestic Policy Council director, who testified Tuesday that she rarely interacted directly with Biden.
Tanden, who wielded authority to use Biden’s autopen for document signatures, claimed she relied on feedback from senior aides, not the president himself.
Bernal, however, was a constant presence, traveling with the Bidens on vacations and standing by the former president even after his disastrous debate performance against Donald Trump in June 2024, which sparked a Democratic revolt and forced Biden to exit the race.
Beyond Cognitive Concerns: Allegations of Misconduct
The subpoena isn’t just about Biden’s mental acuity. Former White House officials hope Bernal will face questions about alleged workplace misconduct, including claims of lewd harassment and bullying in the West Wing.
“Bernal’s influence went unchecked, and his behavior raised red flags among staff,” one ex-official told the New York Post. His lawyer, Jonathan Su, requested a delay to prepare for the Oversight Committee’s questioning, but the GOP is pressing forward, eager to expose what they see as a pattern of dysfunction in Biden’s orbit.
The Trump White House counsel’s refusal to grant executive privilege to Tanden, who testified without such protections, emphasizes that Bernal can expect no such shield.
As Republicans tighten the screws, the probe could reveal not only what Biden’s closest aides knew about his decline but also whether their loyalty enabled a presidency that, in the eyes of critics, stumbled under the weight of its own secrecy.
