Violent Assault and Federal Charges Against Nicaraguan National

Darwin Alexander Davila-Perez, a 33-year-old Nicaraguan who entered the U.S. illegally, was indicted by a Pittsburgh federal grand jury for assaulting an Immigration and Customs Enforcement officer during a December 17 arrest.

The incident began when ICE agents pulled over his vehicle as part of a targeted operation.

Davila-Perez allegedly reversed his car into a law enforcement vehicle containing an officer, then fled on foot, elbowing one agent in the face, attempting to seize an officer’s firearm, biting another’s arm, and swinging a handcuff to strike an officer in the forehead.

The officers suffered contusions, abrasions, and a bite mark. The confrontation stemmed from Davila-Perez’s failed attempt to buy a gun from a licensed dealer by falsely claiming U.S. citizenship, which was denied upon discovering his illegal status.

If convicted, he could face up to 20 years in prison and a $250,000 fine. DHS Assistant Secretary Tricia McLaughlin commented: “Davila-Perez not only chose to break our nation’s immigration laws, but he also lied in an attempt to illegally purchase a gun and then brutally assaulted law enforcement. These are the dangerous situations our officers are facing every day in the field.”

Released Under Biden’s Lax Border Regime

Davila-Perez crossed into the U.S. via the Paso Del Norte bridge in Texas on December 2, 2022, during the Biden administration, and was released into the interior rather than being detained— a decision emblematic of the Democrats’ softer approach to immigration that critics say has flooded communities with potential threats.

This release allowed him to remain free until his recent apprehension, highlighting how such policies have contributed to escalating risks for federal agents.

Rising Attacks on Officers Amid Democratic Demands for Weaker Enforcement

McLaughlin further noted the surge in violence against ICE personnel, stating: “Thanks to rhetoric by sanctuary politicians and encouragement of illegal aliens to evade arrest, our officers are facing a 1,300% increase in assaults against them, a 3,200% increase in vehicular attacks, and an 8,000% increase in death threats against them. Secretary Noem has been clear: anyone who assaults law enforcement will be prosecuted to the fullest extent of the law.”

The case unfolds as ICE conducts nationwide operations, with Congress debating enforcement strategies following tensions in Minnesota. DHS funding expires on February 13, and Democrats are pushing demands to overhaul immigration tactics, including after the Alex Pretti shooting in Minneapolis.

A short government shutdown recently ended, with DHS funding separated amid these disputes, while Border Czar Tom Homan announced a drawdown of 700 agents. This indictment serves as a stark reminder of how Democratic reluctance to prioritize border security continues to endanger officers and complicate national safety efforts.
