Fulton County District Attorney Fani Willis Faces Scrutiny Over Trump Prosecution

Fulton County District Attorney Fani Willis may soon face continued legal consequences stemming from her high-profile prosecution of President-elect Donald Trump. Ashleigh Merchant, the attorney behind the original motion to disqualify Willis from her involvement in the case, believes that Willis could come under investigation by the new Department of Justice due to issues with her handling of the case.

“I would be shocked if she wasn’t investigated by the new Justice Department,” Merchant, who represented Trump co-defendant Mike Roman in Willis’ racketeering case, shared with reporters with the Daily Caller.

Merchant’s motion, filed in January, accused Willis of financial impropriety related to her appointment of Nathan Wade as special prosecutor. Wade, with whom Willis was romantically involved, was allegedly given preferential treatment, and Merchant pointed to vacations that Wade financed using funds linked to his position in the case. These accusations were examined in court, where Judge Scott McAfee found that Willis’ romantic involvement with Wade created a “significant appearance of impropriety.” However, McAfee allowed Willis to remain on the case, provided Wade stepped down.

In a recent development, the Georgia Court of Appeals ruled on Thursday that Willis must be disqualified from prosecuting her case against Trump. The decision marked a victory for Merchant, who expressed her satisfaction with the outcome.

“It’s kind of like Christmas came early,” Merchant remarked, reflecting on the court’s ruling.

Despite this win, Merchant emphasized the uphill battle her team had to fight throughout the case. “We had to fight for a hearing. We had to fight for subpoenas. We had to fight for evidence. We had to fight to call witnesses,” she explained. “I mean, they fought every single step we took.”

The legal saga surrounding Willis’ conduct escalated when, shortly after Merchant filed the motion to disqualify her, Willis publicly defended her actions. In a speech before a church congregation, Willis made the controversial claim that she had paid all special prosecutors the same hourly rate, suggesting that the criticism of her actions was racially motivated. However, contracts obtained by the Daily Caller News Foundation revealed that Wade was initially paid a higher hourly rate than the other attorneys working on the case, including Georgia’s top racketeering expert.

Further complicating matters, Willis and Wade’s personal relationship raised additional questions. The two reportedly took vacations together, during which Wade financed plane tickets and other expenses. However, Willis failed to disclose these gifts on her 2022 financial disclosure. Both Willis and Wade claimed that they had split the expenses equally, with Willis reimbursing him in cash.

Willis’ truthfulness came into question during an evidentiary hearing in February. McAfee, the judge overseeing the case, noted that there were “reasonable questions” about whether Willis and Wade were truthful regarding the timeline of their relationship.

According to Merchant, Willis’ continued actions are increasing her legal liability. “She’s trying to create this idea that she’s this constitutional officer and doesn’t have to play by any of the legal rules,” Merchant said. “And that’s not how it works.”

Merchant pointed to several instances in which Willis has defied legal protocols. In September, she ignored a subpoena from a state senate investigative committee, and she has refused to comply with document requests from the House Judiciary Committee. Moreover, despite a court order following an open records lawsuit filed by Judicial Watch, Willis has not yet handed over documents relating to her communications with Special Counsel Jack Smith and the House Jan. 6 committee.

Merchant believes that Willis’ refusal to cooperate with these legal demands further damages her credibility and creates significant legal exposure. “She’s trying to act like she’s above the law,” Merchant asserted. “She doesn’t get to do that.”

As the legal and ethical questions surrounding her actions continue to unfold, it remains to be seen how Willis’ conduct will be addressed by both state and federal authorities. The growing scrutiny suggests that her prosecution of Donald Trump may not be the only legal battle she faces in the months to come.
