Former DOJ Official Criticizes Democratic Response to Hur Report

Xochitl Hinojosa, a former Department of Justice official, sharply criticized Democratic Party leaders on Tuesday for misleading the public about former President Joe Biden’s mental acuity in response to Special Counsel Robert Hur’s report.

Speaking on CNN’s NewsNight, Hinojosa highlighted the party’s dismissal of the report as “gratuitous” despite its findings being central to Hur’s decision not to prosecute Biden.

“I was at the Justice Department at the time when we released the Hur report, and he was, the entire White House infrastructure at the time, was calling the report gratuitous, and said that Rob Hur should have never called him ‘a well-meaning elderly man with a poor memory.’ And every Democratic pundit, many reporters, were out there saying that it was inappropriate for Rob Hur to say that. And the reality is, the whole reason why he put that in is because it was his whole reason not to prosecute,” Hinojosa, former DOJ Director of Public Affairs, said.

Her remarks emphasize the disconnect between the party’s public stance and the report’s legal reasoning.

Revelations from Audio and New Book

The controversy resurfaced with the release of audio from Hur’s interview with Biden on Friday, revealing the former president struggling with words and recalling key details.

Axios reporter Alex Thompson, a guest on the panel, discussed insights from his book with CNN’s Jake Tapper, Original Sin: President Biden’s Decline, Its Cover-Up, and His Disastrous Choice to Run Again.

Hinojosa expressed frustration, stating, “So it’s really infuriating to hear this happening in the Spring of 2024, around the time that the Hur report was released and certain aspects in Alex and Jake’s reporting really talk about the timeframe being Fall of 2023, whenever he did his interview with Rob Hur, as well as early 2024, when was the release of the report. And so it’s just, it’s really frustrating, I think as a Democratic Party, hearing now that they were lying to everybody, and not only were they lying to everybody, but they were bashing their own cabinet when it came to the Hur report.”

The audio revealed Biden’s admission about retaining classified documents, particularly one on Afghanistan found at his lake house. When questioned, Biden initially said he was unsure how it got there but then conceded, “I guess I wanted to hang on to it for posterity’s sake.”

This admission fueled criticism of the Democratic leadership’s efforts to downplay concerns about Biden’s memory, as detailed in Hur’s report.

Democratic Leadership’s Reaction to the Report

Biden administration officials, including Press Secretary Karine Jean-Pierre, Ian Sams, former Vice President Kamala Harris, and former DHS Secretary Alejandro Mayorkas, labeled the Hur report “gratuitous” after its release, objecting to its description of Biden’s memory lapses.

Jean-Pierre stated, “The reality is, that report, that part of the report does not live in reality. It just doesn’t, it is gratuitous. It is unacceptable and it does not live in reality.”

Democratic Representatives Ro Khanna, Jamie Raskin, and Daniel Goldman echoed this sentiment, calling the report’s language unnecessary. These responses, Hinojosa argued, misrepresented the report’s findings, which were pivotal in Hur’s decision not to pursue charges over Biden’s mishandling of classified documents due to his cognitive challenges.

The backlash against the report, combined with the recent audio evidence, has reignited debates about transparency within the Democratic Party.

Hinojosa’s comments reflect a call for accountability, suggesting that the party’s defense of Biden may have undermined trust by dismissing legitimate concerns raised by the special counsel’s investigation.
