And now a federal judge has ripped Biden to shreds with a brand new court order.
In a scathing rebuke of President Joe Biden’s handling of his son Hunter’s legal troubles, U.S. District Judge Mark Scarsi, who presided over Hunter Biden’s tax evasion case, took the opportunity to sharply criticize both the president and his claims of political motivations behind the charges. The judge’s comments raise troubling questions about the legitimacy of the administration’s approach to the investigation and suggest that the scope of a recent pardon issued by the president may be constitutionally problematic.
On Tuesday evening, Judge Scarsi ruled to end the tax-related criminal proceedings against Hunter Biden in Los Angeles, but not without first delivering a series of pointed criticisms aimed at the president’s claims that the charges were politically motivated. Scarsi, appointed by former President Donald Trump, made it clear that he found the president’s statements to be both baseless and offensive. He specifically took issue with Biden’s assertion that Hunter was “singled out only because he is my son,” pointing out that this claim contradicted the findings of both Scarsi and another federal judge, Maryellen Noreika, who had previously ruled that Hunter was not a victim of selective or vindictive prosecution.
Moreover, Scarsi noted the questionable factual accuracy of the president’s public statements about his son’s past drug use, highlighting that some of Hunter Biden’s crimes occurred after he had acknowledged regaining his sobriety. These remarks were not just a defense of the legal proceedings, but also a stark challenge to the narrative the White House had tried to construct around Hunter’s legal troubles.
“The President’s statement illustrates the reasons for the Court’s disapproval, as representations contained therein stand in tension with the case record. For example, the President asserts that Mr. Biden ‘was treated differently’ from others ‘who were late paying their taxes because of serious addictions,’ implying that Mr. Biden was among those individuals who untimely paid taxes due to addiction. But he is not,” the court order reads.
The judge also questioned the nature of the presidential pardon issued to Hunter Biden, suggesting that it might be constitutionally flawed. While the president has broad powers to grant clemency, Scarsi found the scope of the pardon troubling, particularly its prospective elements.
Biden’s pardon covered the period from January 1, 2014, to December 1, 2024 — the day it was signed — potentially extending it to include hours on the day the pardon was issued. Scarsi pointed out that such a prospective pardon could exceed the bounds of the president’s constitutional authority, even though he decided to treat it as valid in the context of the tax case.
In his five-page order, Scarsi made it clear that a press release, such as the one issued by the president, should not be mistaken for a pardon. “A press release is not a pardon,” Scarsi firmly stated, adding that the Constitution does not grant the president the power to “rewrite history.” This statement was a stark reminder of the limitations of executive power and the importance of legal processes that are not swayed by political motives.

While Scarsi did ultimately cancel the sentencing hearing set for December 16 in the tax case, the serious implications of this ruling cannot be ignored. The president’s actions in the case — including the pardoning of his son — continue to raise questions about the politicization of the justice system under Biden’s watch. This latest turn of events comes just months after Hunter Biden’s guilty plea in September to charges of tax evasion and his conviction in a Delaware federal court related to a 2018 gun purchase.
The involvement of David Weiss, a Trump appointee and current special counsel, in both the tax and gun-related cases, has further complicated the narrative surrounding Hunter Biden’s legal battles. His role in the prosecution raises even more questions about the extent to which politics may have influenced these proceedings, further undermining the credibility of the White House’s claims of a fair and impartial investigation.
As Hunter Biden’s legal troubles continue to unfold, President Biden’s handling of the situation will undoubtedly remain under scrutiny. The critical tone taken by Judge Scarsi and the unresolved constitutional questions surrounding the pardon leave a cloud of doubt over the fairness and legitimacy of the administration’s actions in this case. The political pundit world has been mostly unanimous in their rebuke of Joe Biden for this move to pardon Hunter Biden. Even those on the Left and within the Democrat Party are saying this move only helps build the case that the Democrats are a bunch of liars and hypocrites. They spent the entire election season claiming to be the party of “freedom” and “law and order,” but then they turn their backs on law and order when it’s convenient for them.
Not only that, but Joe Biden and his allies have been saying he would never pardon Hunter Biden under any circumstances. They didn’t even say “maybe.” They outright said “no” dozens and dozens of times when asked by reporters. So they throw the law and order baby out the window after they’ve been lying about it for months and years.
