That’s why this federal prosecutor’s announcement on Fox News stunned the entire Trump administration.
The Democrats were certainly reeling after their huge 2024 elections losses. But now, they’re starting to team up with the long-time Washington, D.C. establishment that is trying to fight back against the Trump administration’s efforts to reform the government and return it to being more transparent for the people. The bureaucratic class does not want this at all, and they will do anything to get in the way of President Donald Trump and his allies.
One of the ways they’re seeking to do this is to get the Trump administration stuck in court cases and effectively slow down the Trump administration with constant litigation. Left-wing organizations and old-school bureaucratic suits are suing the Trump administration for everything they announce, especially the big game-changing executive orders concerning illegal immigration and government spending cuts. There is some light for the Trump administration, though.
Former Federal Prosecutor Defends the Legitimacy of the Department of Government Efficiency (DOGE)
In an appearance on Fox & Friends this past Wednesday, former federal prosecutor Andy McCarthy addressed growing criticisms from Democrats and liberal advocacy groups regarding the legitimacy of the newly established Department of Government Efficiency (DOGE). McCarthy asserted that the department is fully legitimate, contrary to the claims made by its detractors.
DOGE, created by President Donald Trump through an executive order on January 20, repurposes the United States Digital Service (USDS) while adding additional responsibilities, including the hiring of new federal employees. A subsequent order issued on February 10 further expanded the department’s mandate. McCarthy’s comments came in response to legal challenges mounted by Democrats and government unions, which argue that the formation and actions of DOGE overstep constitutional boundaries.
McCarthy explained that the litigation surrounding DOGE is designed to stall the department’s efforts, and is being backed by deep-pocketed groups. “The litigation is kind of designed to slow things down and they have vast resources to conduct this kind of litigation,” McCarthy told Fox & Friends guest host Emily Compagno. “You have sort of these cabals of state attorneys general, you have all kinds of well-heeled left-wing groups that can do this. But ultimately, I think, if you get clear rulings from the court, a lot of this stuff will fade away.”
McCarthy further pointed out that many of the legal challenges against DOGE rest on the misconception that the agency is somehow illegitimate. “It seems to me the weakest position that they have is that executive branch officials, and whether they like it or not, they keep calling it the so-called DOGE, as if it didn’t exist,” McCarthy said. “It actually is a component of the executive office of the president in the White House, it’s a refinement of something that was begun under Obama.”
The former prosecutor emphasized that DOGE is, in fact, a legitimate government entity that answers directly to the president, the head of the executive branch. He added, “So, this is a legitimate government entity, and they answer to the president, who runs the executive branch. So the idea that an executive official answerable to the president can’t look at what’s going on in executive agencies is pretty nutty and I think that should fade away fast.”
One key development in the ongoing legal battle is the Feb. 4 memo from the Office of Personnel Management (OPM), which recommended that chief information officers (CIOs) at various government agencies be reclassified as political appointees and work with DOGE. This move, part of an effort to streamline government operations, has drawn additional criticism from government unions.
In another notable legal development, a federal judge extended the deadline for a buyout offer sent to over two million federal employees. The case, brought by the American Federation of Government Employees (AFGE), challenges a Trump administration initiative to reduce federal payroll costs. U.S. District Judge John J. McConnell Jr., a Democratic donor and Obama-era appointee, threatened administration officials with criminal contempt charges over a spending freeze imposed by President Trump.
McCarthy acknowledged that the litigation process could take some time to resolve, especially with the current political climate and the involvement of lower court judges who may seek to delay proceedings. “I think what we are seeing is a lot of forum shopping and there is a lot of opportunity for these lower court judges to slow walk stuff,” he said.
“And then the thing you have to worry about up in the Supreme Court is that you have some judges who just don’t like the emergency docket and they like the idea, even if there are justices who you think would be inclined to rule the president’s way, they like things to come in regular order, rather than expedited,” Mr. McCarthy added.
While the legal battles surrounding DOGE continue, political protests have also erupted in response to the department’s actions. On February 4, Democrats gathered outside the headquarters of the United States Agency for International Development (USAID) and the Treasury Department to protest DOGE’s influence. The protests were sparked by the announcement that Tesla CEO Elon Musk, in his role as chairman of DOGE, had plans to close down the USAID.
Most recently, there have been rumors of the possibility of the Trump administration teaming up with former Tea Party legend Ron Paul to head up an audit of the Federal Reserve, which has long been a dream for the more fiscally conservative members of the Republican Party. Economic experts say that Ron Paul leading an effort to audit the Fed would be a game-changing moment in American history given the consequences that could follow.
