Biden White House’s Role in the Trump Classified Documents Case Revealed

Recently obtained emails have shed light on the Biden White House’s involvement in the National Archives and Records Administration’s (NARA) investigation into the classified documents case against former President Donald Trump. These emails, acquired through a lawsuit and released by the nonprofit conservative group America First Legal, indicate that the White House actively cooperated with NARA, allowing the agency to lay the groundwork for the federal case against Trump. This case was eventually dismissed.

The emails suggest that the Biden administration’s engagement with NARA in 2021 played a significant role in setting the stage for the Justice Department’s investigation into Trump’s handling of classified documents. In one notable instance, Jonathan Su, the Deputy White House Counsel at the time, participated in a phone call with NARA officials to discuss missing boxes of documents that Trump was alleged to have improperly retained after leaving office. The discussions delayed NARA’s official referral to the Department of Justice (DOJ), with the White House filing a “special access request” the following year, further complicating the timeline.

America First Legal, which has been critical of the Biden administration’s actions, quickly reacted to the emails. They pointed out that the new information reveals that the prosecution against Trump was “a sham” and involved the Biden White House from the outset, long before NARA’s official referral to the DOJ. They also took to social media, stating: “New NARA emails further confirm that the classified documents case against President Trump was a sham prosecution that involved the Biden White House from the start – long before NARA’s official referral of classified documents to DOJ for investigation.”

The case in question was initially centered around the accusation that Trump took classified documents with him to his Mar-a-Lago residence in Florida after losing the 2020 presidential election. The federal case, which alleged mishandling of classified materials, was eventually dismissed.

America First Legal, commenting on the newly revealed timeline, argued that the federal investigation and subsequent FBI raid on Mar-a-Lago were not about securing classified documents but rather part of a broader political strategy to target Trump. The group stated, “This new timeline is further proof that Biden’s FBI raid on Mar-a-Lago was never about securing classified documents — it was always about weaponizing the full force of the Department of Justice against President Trump by whatever means necessary.”

Further details in the emails show how NARA General Counsel Gary Stern communicated with his colleagues about discussions with Su. On September 15, 2022, Stern wrote that he had “brought Su up to speed on the issue” regarding the missing documents. He described a situation where the White House expressed interest in having a meeting involving certain individuals, possibly former White House staffers, to clarify the document issue. According to Stern’s communication, the White House needed access to materials from the prior administration, and NARA would facilitate this through a special access request.

These revelations suggest that NARA delayed sending a letter to the DOJ regarding the case, choosing instead to engage in discussions with Trump’s legal team. NARA acknowledged that cooperation from Trump’s team could potentially resolve the issue without the need for a broader investigation. However, as Trump’s team resisted turning over the documents, arguing they were rightfully his, America First Legal previously argued that the Biden administration used the “special access request” as a means to create the legal grounds for the FBI’s raid on Mar-a-Lago.

In 2022, Just the News first reported that the Biden White House had been directly involved in working with both the DOJ and NARA to initiate the criminal probe into Trump’s alleged mishandling of classified documents. The White House’s role included eliminating Trump’s claim to executive privilege, which cleared the way for the FBI to review materials obtained from his Florida estate and escalated the investigation significantly.

These emails, revealing the Biden administration’s coordination with NARA and the Justice Department, have intensified the ongoing debate about the motivations behind the investigation into Trump. Critics, particularly those aligned with America First Legal, see the new timeline as evidence that the pursuit of criminal charges against Trump was politically motivated.

Joe Biden Lies Of Being Uninvolved In Trump Indictments Come To Light

Back in 2023 when Donald Trump was originally indicted for the classified documents case, Joe Biden had told reporters that he had no part in the matter. He said that he had no intentions to discuss the case with the Department of Justice and the U.S. attorney general at the time. “I have not spoken to him at all and I’m not going to speak with him,” Joe Biden said.

At the time, Donald Trump and his allies maintained that the Joe Biden White House had a hand in these indictments. The mainstream media, of course, said Donald Trump was peddling “dangerous” conspiracy theories of Joe Biden being involved with no evidence of that being the case. Donald Trump accused the “corrupt Biden administration” of trying to derail his third run for President.

Today, the idea that Joe Biden was in some way involved in the development of these cases is no longer a “conspiracy.” If anything, most legal experts and political commentators would agree that it seems likely that Joe Biden’s White House was more involved than they were willing to let on at the time.
