GOP Attorneys General Back Trump’s Birthright Citizenship Order
Republican attorneys general from 18 states are mounting a strong defense of President Donald Trump’s executive order on birthright citizenship, pushing back against legal challenges from Democrat AGs and Left-wing organizations.
The GOP officials are set to file an amicus brief on Monday in support of Trump’s move, which seeks to clarify that birthright citizenship does not extend to children born to illegal immigrants or temporary visitors.
Iowa Attorney General Brenna Bird, who is leading the charge, made it clear that the original intent of the Constitution does not support so-called “anchor babies.”
“If someone comes on a tourist visa to have an anchor baby, they are not under that original meaning of the United States Constitution,” Bird told Fox News Digital.
Bird also highlighted the financial burden placed on taxpayers when non-citizens give birth in the U.S.
“Oftentimes, when this has happened, it’s the taxpayers that are paying for the health care through Medicaid or through hospitals, paying for care for someone to have a child, or the state child health insurance system as well,” she explained.
Democrats and Left-Wing Groups Challenge Trump’s Authority
The Republican-led brief comes in direct response to lawsuits filed by 18 Democrat-led states, which claim that Trump’s executive order is unconstitutional and “unprecedented.”
“The President has no authority to rewrite or nullify a constitutional amendment or duly enacted statute,” the lawsuit argues, further asserting that Trump lacks the power to dictate who qualifies for U.S. citizenship at birth.
Among those challenging the order are attorneys general from deep-blue states like California, New Jersey, Massachusetts, and Colorado, along with local governments in San Francisco and Washington, D.C. Additionally, the American Civil Liberties Union (ACLU) wasted no time in filing its own lawsuit on behalf of activist groups, alleging that the order defies congressional intent and Supreme Court precedent.
GOP AGs Argue for Constitutional Integrity and State Sovereignty
The 13-page amicus brief, signed by Republican AGs from states including Florida, Missouri, Arkansas, and South Dakota, argues that Trump’s order is fully in line with the original meaning of the Fourteenth Amendment. Furthermore, it highlights how the current misinterpretation of birthright citizenship harms states by encouraging illegal immigration.
“The Plaintiffs’ erroneous Citizenship Clause interpretation will continue the powerful incentive for citizens of foreign countries to give birth on American soil, even if they must illegally enter this country to do so,” the brief states.
The filing also references a harrowing account from a border hospital administrator, who described pregnant women arriving in active labor, drenched and shivering from having just crossed the river — all in a desperate attempt to ensure their child is born in the U.S.
Trump’s order, titled Protecting the Meaning and Value of American Citizenship, is among the first executive actions he signed after taking office in January.
It affirms that “the privilege of United States citizenship does not automatically extend to persons born in the United States” when their parents are either illegal immigrants or temporary visitors.
“President Trump is restoring the meaning and value of American citizenship, and also making sure that if someone is breaking the law, they won’t be rewarded for that by getting citizenship,” Bird emphasized.
“And so it’s following the Constitution and making sure that we’re upholding our immigration laws.”
