Trump’s Border Czar Defends Deportation of Terrorists Amid Judicial Pushback
Tom Homan, President Donald Trump’s border czar, appeared on Fox and Friends Monday, expressing bewilderment and frustration over a federal judge’s order to bring deported terrorists back to the United States. Speaking with co-host Lawrence Jones, Homan staunchly defended the administration’s recent actions to remove dangerous criminals from the country, calling Trump’s approach a “game changer” in the fight to secure the nation.
The controversy stems from a Saturday injunction issued by United States District Judge James Boasberg of the District of Columbia. The judge’s ruling demanded that the Trump administration reverse the course of two planes that, according to the White House, were carrying members of the notorious Tren de Aragua (TdA) gang from Venezuela to El Salvador. The deportation was part of a larger effort by Trump to expel over 200 violent criminals, including members of both TdA and the MS-13 gang, under the authority of the Alien Enemies Act.
“I don’t know why. I don’t know why any judge would want terrorists returned to the United States,” Homan told Jones during the interview. He praised a video posted on X by El Salvadoran President Nayib Bukele showing the deportation process, which Jones described as “incredible.” Homan added, “First of all, that video, what a beautiful thing to see.”
Homan explained that Trump’s decision to invoke the Alien Enemies Act—a rarely used legal tool—marked a significant shift in immigration enforcement. “Look, President Trump, by proclamation, invoked the authorities of [the] Alien Enemies Act. Which he has a right to do and it’s a game changer and we removed over 200 violent criminals from the United States. Just not TdA, but also MS-13,” Homan said. He argued that these deportations directly enhance public safety, aligning with the priorities American voters expressed in electing Trump.
“The actions of President Trump made this country safer. Every criminal alien, every criminal public safety threat and national security threat removed from country makes this country safer. That’s what American voters voted for. That’s the mandate of the president and the president is keeping his promise.”
Since taking office on January 20, 2025, President Trump has moved swiftly to tackle illegal immigration. Among his first actions were executive orders designating Mexican drug cartels as foreign terrorist organizations, declaring a national emergency at the southern border, and instructing federal agencies to deploy all available resources to strengthen border security. Homan praised these efforts, calling Trump a transformative leader.
“This president, President Trump is a game changer,” he said. “The Alien Enemies Act hasn’t been used in a long time and when I watched the video and involved this week when this whole movement, this is an extraordinary thing that President Trump is doing to keep his promise to the American people to make the country safe again and he’s doing a fabulous job.”
The deportation flights, however, hit a snag when details were leaked to the press, triggering judicial intervention. “Information was leaked … I don’t quite know how it got leaked, but there was a court – emergency court hearing on five people that were … scheduled to be deported. The judge had a written order say these five people can’t be removed right now,” Homan explained.
By the time Judge Boasberg issued his directive to return the planes, they were already in international waters en route to El Salvador. “We are already in international waters. We’re outside the borders of the United States. I’m the border czar. Once you are outside the border, you know, it is what it is,” Homan said.
He stood firm on the administration’s decision to proceed with the deportations despite the judge’s order. “When they’re in international waters already on the way south, close to landing, do you know what? We did what we had to do, removed terrorists … significant public safety threats to the United States by the order, the proclamation by the president of the United States. We did the right thing,” Homan asserted.
When Jones pressed him on the judge’s rationale, Homan admitted he was at a loss. “Your guess is as good as mine,” he told the co-host, adding, “That just defies logic.” For Homan and the Trump administration, the mission remains clear: prioritize the safety of Americans by removing those deemed a threat, regardless of judicial pushback. As the border czar sees it, Trump is delivering on his promise—and the results speak for themselves.
When asked by reporters how the Trump administration can justify using a 200-year-old law to deport individuals with a speedy due process compared to usual, Tom Homan shared that the age of the law doesn’t matter considering we still consider the U.S. constitution to be legally binding even though it’s also nearly 250 years old.

At this time, the U.S. Supreme Court has not ruled on any of the major executive decisions from the Trump administration on matters of illegal immigration and their deportation efforts.
