Biden Administration Accused of Inflating Immigration Arrest Numbers
Homeland Security officials are accusing the Biden administration of manipulating immigration enforcement data to inflate arrest numbers. According to these officials, the administration has been counting illegal immigrants who were caught and quickly released rather than those who were actually detained or deported.
Todd Lyons, the new acting director of U.S. Immigration and Customs Enforcement (ICE), did not mince words in describing the Biden-era tactics. “We found tens of thousands of cases that were recorded as arrests when in fact these instances were illegal aliens that were simply processed and released into American communities,” Lyons revealed.
He further explained that the Biden administration’s decision to count these “arrests” created a false impression of strong enforcement. “The previous administration counted these arrests even though no immigration enforcement action was taken,” Lyons added, calling it nothing more than “enforcement theater.”
Trump’s ICE Arrests Show Stronger Enforcement
With the numbers corrected, ICE officials argue that arrests under President Trump’s administration already outpace Biden’s, despite being in office for only a short period.
ICE reported 32,809 interior arrests between January 20 and March 10—nearly matching the total number of legitimate arrests for all of 2024 once the Biden administration’s “pass-through” cases are removed from the count.
Even more striking, among those arrested were 1,155 known or suspected gang members and 39 known or suspected terrorists—almost three times the rate seen under Biden’s watch, according to ICE data.
These figures highlight a significant shift under Trump’s leadership, where the focus has returned to targeting dangerous criminals instead of inflating statistics with meaningless arrests.
Biden’s Policies Created Loopholes for Illegal Immigrants
A senior ICE official revealed that the directive to count these misleading “pass-through” arrests originated from Biden’s Homeland Security Department. This policy not only misrepresented actual enforcement but also gave illegal immigrants a legal foothold to remain in the U.S.
“This gave them a pathway to establishing a long-term … residency here in the U.S.,” the official explained.
By documenting an ICE “arrest,” illegal immigrants could present themselves as being in a legal process—qualifying them for local services and other benefits.
The official also warned that this policy undercut ICE’s ability to target the most dangerous offenders.
“These pass-through arrests, while they looked great, it really hindered our officers. We weren’t out there looking for the worst of the worst,” he said.
The contrast could not be clearer: under Trump, ICE is refocusing on actual enforcement, removing dangerous criminals, and rejecting the Biden administration’s deceptive tactics that allowed illegal immigrants to slip through the cracks.
