Immigration Authorities Release Two Men Later Accused of K*lling 12-Year-Old Houston Girl Despite Available Detention Beds
Federal immigration authorities previously released two Venezuelan nationals, who are now accused of m*rdering a 12-year-old girl in Houston, despite the availability of numerous detention beds that could have kept them in custody, according to a congressional report.
Franklin Joe Pena Ramos, 26, and Johan Jose Martinez Rangel, 22, were arrested last week by the Houston Police Department for the strangulation death of Jocelyn Nungaray. Her body was discovered days earlier in a local creek. Immigration and Customs Enforcement (ICE) confirmed that both men were released into the country on the same day they unlawfully crossed the U.S.-Mexico border. However, detention data from a House committee indicates they could have remained in physical custody.
An ICE spokesperson told the Daily Caller News Foundation that both men entered the U.S. illegally without inspection, parole, or admission by a U.S. immigration officer. Martinez was apprehended by the U.S. Border Patrol near El Paso, Texas, on March 14 and released the same day with a notice to appear. Similarly, Pena was apprehended near El Paso on May 28 and released the same day.
The House Homeland Security Committee’s report criticized the Biden administration for releasing the two men when thousands of detention beds were available. “On March 10, roughly 2,500 ICE beds stood empty, while on May 19, roughly 5,000 beds were available, and around 3,000 were available on June 2,” the report states.
The report emphasized that these tragedies were preventable at multiple levels. For fiscal year 2024, Congress appropriated a minimum detention bed requirement of 41,500. However, House Homeland Security Chairman Mark Green accused the Biden administration of consistently refusing to fully utilize these ICE beds since early March.
Jocelyn Nungaray’s body was discovered in a north Houston creek by a passerby. Investigators believe she had snuck out of her home, and surveillance footage led them to Pena and Martinez, who were living together at a local apartment complex.
RJ Hauman, president of the National Immigration Center for Enforcement (NICE) and a visiting fellow at The Heritage Foundation, criticized the administration’s approach. He claimed that every form of detention has been transformed into a “catch-and-release” system. Hauman noted that GPS monitoring has decreased and that many illegal aliens are quickly unenrolled from such programs.
“Every form of detention has been quietly morphed into a catch-and-release cog,” Mr. RJ Hauman shared with reporters on the matter. He went on to add that Joe Biden refuses to use all the tools at his disposal. “GPS monitoring has plummeted and many illegal aliens like these m*rderers are often quickly unenrolled.”
“Not only does Biden refuse to fill all detention beds provided by Congress, he doesn’t properly use alternative forms,” Mr. Hauman added to his comments.
“They need to explain while single adult males from gang havens aren’t in custodial detention or promptly removed – or else tragedies like this will continue to happen,” the National Immigration Center head argued.
The Biden administration and the Department of Homeland Security have faced ongoing criticism from Republicans regarding the utilization of detention beds amid the border crisis. Chairman Green accused Secretary Mayorkas of consistently asking for fewer ICE beds than the previous administration and failing to use the resources Congress authorized, despite record numbers of illegal crossings.
“The fact is that ever since 2021, Secretary Mayorkas has consistently asked for fewer ICE beds than the previous administration, and then failed to make use of the resources Congress ultimately authorized, despite record numbers of illegal crossings on his watch,” Republican Mark Green shared with reporters in an official statement.
The m*rder of Jocelyn Nungaray follows other high-profile crimes allegedly committed by illegal immigrants, including the m*rder of Georgia nursing student Laken Riley, the r*pe and m*rder of a Maryland mother of five, and the shooting of two New York Police Department officers during a police chase.
ICE confirmed that immigration detainers have been lodged with the Harris County, Texas Jail for both Martinez and Pena. The Texas district attorney involved in the case indicated that evidence suggests a likely s*xual assault occurred.
Democrats have been facing negative attention on the immigration issue as more and more Americans are quick to blame the Biden administration for the sad perishing of Americans at the hands of illegal immigrants.
