Biden Administration Declares All-Out Legal War On Trump and Red States

The Biden-Harris administration has taken an aggressive stance in pursuing litigation against several red states, raising concerns among legal experts about potential infringements on states’ rights. States like Texas, which have enacted measures to control the influx of illegal migrants — an issue that has reached record levels under the current administration — now find themselves facing lawsuits from the federal government. Additionally, states that have implemented laws conflicting with the administration’s policies on issues such as abortion and gender have also encountered legal challenges.

Hans von Spakovsky, a senior legal fellow at the Heritage Foundation’s Edwin Meese III Center for Legal and Judicial Studies, described the volume of lawsuits filed by the Biden administration as “unprecedented.” He criticized the Department of Justice (DOJ) for what he views as an abuse of its law enforcement power and an infringement on federalism.

The DOJ recently filed a lawsuit against Virginia over an initiative aimed at removing non-citizens from the voter rolls, claiming the timing was “too close” to an upcoming election. Virginia’s Republican Governor, Glenn Youngkin, labeled this action a “desperate attempt to attack the legitimacy” of the state’s electoral process. Youngkin pointed out that the lawsuit was an attempt to undermine a law, originally signed by a Democrat, that mandates the removal of noncitizens from voter registration lists.

Similarly, Alabama faced legal action when state officials sought to address non-citizen registrations after the Department of Homeland Security issued noncitizen identification numbers to thousands of registered voters. The DOJ argued that removing individuals from the registration list within 90 days of an election violated federal law.

The administration’s legal efforts also extend to other states. The DOJ has challenged Arizona’s proof of citizenship law, as well as Georgia’s election integrity law. In a notable development, the Supreme Court allowed Arizona to partially enforce its law, indicating that legal battles over voting rights will likely continue.

Georgia’s Secretary of State, Brad Raffensperger, has raised concerns about possible coordination between the DOJ and activist groups regarding these lawsuits. Von Spakovsky emphasized that rather than suing states, the federal government should support them in enforcing immigration laws and addressing illegal immigration issues.

The Biden DOJ’s aggressive stance also includes lawsuits against states like Texas, Iowa, and Oklahoma over laws aimed at empowering local authorities to arrest illegal migrants. Legal experts point out that recent Supreme Court rulings have limited the scope of state laws on immigration, complicating the legal landscape for states attempting to enact tougher measures.

In the realm of “reproductive rights”, the Biden administration has challenged Idaho’s abortion ban shortly after the Supreme Court overturned Roe v. Wade. This lawsuit alleges that Idaho’s law prevents necessary medical procedures in emergency situations, raising further questions about the balance between state and federal law.

Currently, the DOJ is also contesting Tennessee’s ban on child s*x change procedures for minors, with these cases highlighting ongoing tensions over state autonomy and federal oversight.

The Real Reason Biden-Harris Are Waging Legal Warfare Right Now

Some experts suggest that the Biden administration may be accelerating its litigation efforts ahead of the upcoming elections. Josh Blackman, a professor at the South Texas College of Law Houston, noted that if former President Trump were to win, it could complicate the DOJ’s ability to terminate pending cases.

“If Trump wins, it will be hard for the DOJ to terminate pending cases. It is also possible private groups can move to intervene to keep the cases alive,” Mr. Blackman said.

However, not all legal observers agree that the Biden administration’s litigation efforts are unprecedented. Devin Watkins from the Competitive Enterprise Institute argues that lawsuits over voting issues are common, and he does not believe the federal government is filing lawsuits against states more frequently than previous administrations.

During the Trump administration, similar legal actions were taken against states like California over various policy disagreements, indicating that legal confrontations between state and federal authorities are a recurring aspect of the political landscape.

Though even Devin Watkins has admitted that if the Biden-Harris administration’s efforts proved successful, it could produce an infringement on the rights of states to govern themselves according to the U.S. Constitution.
